Barbour Gift Card Terms and Conditions

1. General

These terms and conditions apply to digital gift cards purchased online at www.raouls.live/gb (“Gift Cards”).

They also apply, where relevant, to any merchandise cards or digital merchandise cards issued by Barbour following a return (“Merchandise Cards”). For the avoidance of doubt, Merchandise Cards may be used in the same way as Gift Cards in accordance with paragraph 2.

Gift Cards are provided by J. Barbour & Sons Ltd, trading as Barbour (“Barbour”, “we”, “us” or “our”), in partnership with Stored Value Solutions UK Limited (“SVS”), our gift-card technology and fulfilment provider.

By purchasing, receiving or using a Gift Card or Merchandise Card, you agree to these terms and conditions.

We may update these terms and conditions where reasonably necessary, including to reflect changes in applicable laws, regulations, technology or the operation of our Gift Card programme. The latest version of these terms and conditions will be available at www.raouls.live.

Any changes made to these terms and conditions by Barbour will not unfairly reduce the value or validity of a Gift Card that has already been purchased or issued, unless the change is required by law or is necessary to protect customers or prevent fraud.

Nothing in these terms affects your statutory rights.

2. Where Gift Cards can be used

Gift Cards can be redeemed against purchases made:

·       online at www.raouls.live/gb

Gift Cards cannot be used at Barbour partner stores, concessions, outlet stores or authorised stockists unless expressly stated otherwise.

Gift Cards purchased or issued in the United Kingdom can only be redeemed through participating UK Barbour sales channels as outlined above. They cannot be redeemed on another country version of the Barbour website.

Gift Cards can be used as full or part payment for eligible purchases. If the available balance does not cover the full purchase price, the remaining amount can be paid using another payment method accepted by Barbour.

Gift Cards cannot be used to:

·      purchase another Gift Card;

·      obtain cash;

·      pay for a previous purchase or an outstanding account; or

·      make purchases for resale or other unauthorised commercial purposes.

3. Purchasing a Gift Card

Gift Cards can be purchased:

·      in digital format online (“Digital Gift Cards”) at www.raouls.live/gb

The maximum value of a Gift Card is £400 per Gift Card. No minimum value currently applies.

We may limit the number or total value of Gift Cards that can be purchased in a single transaction or over a specified period.

We may refuse or cancel the purchase of a Gift Card where:

·      payment cannot be authorised;

·      the information supplied is incomplete or inaccurate;

·      we reasonably suspect fraud, misuse or unauthorised resale;

·      the order breaches these terms; or

·      we are required to do so by law.

If we cancel the purchase of a Gift Card after payment has been taken, the amount paid will be refunded to the original payment method.

4. Payment

Digital Gift Card purchases, will be processed by SVS on Barbour’s behalf (including payments for and delivery of the Digital Gift Card for the avoidance of doubt).

The payment methods accepted for Gift Card purchases will be shown during checkout.

You must be aged 18 or over to purchase a Gift Card using a credit card.

The transaction for the purchase of the Gift Card will show on your bank statement as “Barbour Buyatab”.

A contract for the purchase of a Gift Card is formed between You and SVS when your order is accepted by SVS and you receive an order-confirmation email from SVS.

5. Digital Gift Card delivery

Digital Gift Cards will be sent to the recipient’s email address provided during checkout.

You may be able to choose immediate delivery or select a future delivery date.

We aim to send Digital Gift Cards shortly after an order has been successfully processed. Security or payment checks may occasionally delay delivery.

You are responsible for providing a complete and accurate recipient email address. Barbour and SVS are not responsible where a Digital Gift Card cannot be delivered, or is delivered to the wrong person, because incorrect information was supplied.

If a Digital Gift Card has not arrived, the purchaser or recipient should check the relevant junk or spam folder before contacting Barbour Customer Services.

We may delay or withhold delivery while reasonable security, payment or fraud-prevention checks are completed.

6. Activation and balance

A Gift Card must be successfully activated before it can be used.

The value of each purchase will be deducted from the available balance. Any remaining balance can be used towards future eligible purchases until the Gift Card expires.

No change will be given in cash.

Customers can check the balance and expiry date of a Gift Card:

·      online at https://www.raouls.live/gb/gift-card-balance-check.html;

·      by contacting Barbour Customer Services.

7. Validity and expiry

Gift Cards are valid for 24 months from the date of purchase.

Merchandise Cards are valid for 24 months from the date on which they are issued.

Once the applicable validity period has expired, the Gift Card or Merchandise Card cannot be used or reactivated. Any remaining balance will be forfeited and will not be refunded, except where required by law.

A Gift Card can be used until its balance reaches zero. Once a Gift Card has a zero balance, it will become invalid after 90 days and cannot subsequently be reactivated or reused.

Gift Card balances can be reloaded, subject to any applicable value and transaction limits as outlined above.

8. Returns and refunds for products purchased with a Gift Card

Products purchased using a Gift Card remain subject to Barbour’s applicable Returns Policy and Terms of Sale.

If a purchase was paid for entirely using a Gift Card, any refund will be returned to the original Gift Card or issued as a new Gift Card or Merchandise Card.

If more than one payment method was used, the refund will be allocated in the following order:

1.     first to the debit card, credit card, PayPal account or other payment method used; and

2.     any remaining amount to the Gift Card or as a new Gift Card or Merchandise Card.

Any Gift Card or Merchandise Card issued as part of a refund will be sent to the email address associated with the original order unless another method is agreed.

This section does not affect your statutory rights where a product is faulty, not as described or otherwise does not conform to the contract.

9. Cancelling or returning a Gift Card

If you purchase a Gift Card online, you have the legal right to cancel your order within 14 days, beginning on the day after the Gift Card is received, subject to the conditions below.

To request cancellation of a Gift Card contact Barbour Customer Services using the details below.

To request cancellation of a Digital Gift Card, please contact SVS using the details below.

We may require the original Gift Card to be returned or cancelled before a refund can be issued.

A Gift Card cannot be cancelled or refunded after it has been used in whole or in part, except where required by law.

Where a cancellation is accepted, the refund will be made to the original payment method. Gift Cards cannot otherwise be exchanged for cash.

10. Lost, stolen, damaged or deleted Gift Cards

Barbour and SVS are not responsible for a Gift Card that is lost, stolen, destroyed, damaged, deleted, used without permission or sent to an incorrect address because incorrect information was supplied.

We will not replace a Gift Card or refund its balance in these circumstances.

We may investigate if satisfactory proof of purchase is provided and the Gift Card balance has not already been used.

You are responsible for keeping the Gift Card number, barcode, PIN and any associated security information confidential.

11. Misuse and cancellation

Gift Cards cannot be resold, transferred for value or used for commercial or promotional purposes without Barbour’s prior written permission.

We may refuse, suspend or cancel a Gift Card where we reasonably believe that:

·      it has been obtained, altered or used fraudulently or unlawfully;

·      it has been purchased using a payment that has failed or been reversed;

·      it has been obtained or used in breach of these terms;

·      its continued use may cause harm to Barbour, SVS, our customers or another person; or

·      we are required to do so by applicable laws.

Where reasonably possible and provided it is permissible to do so in accordance with applicable laws, we will explain the reason for the restriction.

12. Service availability

We will take reasonable care to ensure the Gift Card service is available, but we cannot guarantee uninterrupted access to Gift Card systems.

If a temporary technical problem prevents a Gift Card from being used, we may ask you to use another payment method or complete the purchase later.

Subject to paragraph 13, we will not be responsible for a delay or failure caused by circumstances outside our reasonable control.

13. Liability

Nothing in these terms excludes or limits our liability for:

·      death or personal injury caused by our negligence;

·      fraud or fraudulent misrepresentation;

·      breach of your statutory consumer rights; or

·      any other liability that cannot legally be excluded or limited.

Subject to the above, Barbour is not responsible for losses that were not reasonably foreseeable when the Gift Card was purchased.

Barbour supplies Gift Cards for domestic and private use. We are not responsible for business losses arising from the use of a Gift Card purchased for personal use.
